WEDDING VENUE TERMS & CONDITIONS

1. DEFINITIONS 

i.      The "Owner" is Sashabel Pty Ltd trading as "Lauderdale Cottage".

ii.     The "Venue" is "Lauderdale Cottage", 74 Risdon Road, New Town, and its equipment, grounds, accessories and buildings.

iii.    The "Hirer" refers to the person, firm or corporation hiring the Venue and equipment from the Owner or Venue.

iv.    The "Hire Period" is between the first setup and final removal of all the Hirer's and their associated parties' equipment. 

v.     The "Event Window" is that period when the Hirer's guests are in attendance.

vi.    "Terms" means these Terms and Conditions of Hire. 

 

2. HIRE PERIODS 

i.      Hire rates are based on 8 am Friday to Monday 5 pm to allow setup and pack down. Other hire periods can be negotiated. The Venue will provide a quote for an extended hire period at the request of the Hirer. 

ii.     The Hirer's guests are not permitted on the premises outside the Event Window (unless specified, being 9hrs from 2 pm-11 pm on the day of the event). 

iii.    The Contract of Hire does not create any lease or tenancy of the Premises but is merely a license to occupy.

iv.    The Hirer acknowledges that the Hire Fee does not include the following services:

a)   audiovisual equipment and assistance;

b)   catering;

c)   security;

d)   furniture 

e)   setup/set-down labour costs.

f)    lighting beyond what already exists at the Venue 

g)   marquees and ablution facilities 

 

3. DEPOSIT, PAYMENTS AND OTHER FEES 

i.      A deposit of 50% of the total hire/service cost is required to confirm the booking.

ii.     Full payment is required thirty (30) days before the event. Non-payment will result in the booking’s cancellation. The deposit is non-refundable. 

iii.    Bookings placed less than thirty (30) days from the event require full payment to secure the booking. 

iv.    All custom or additional service requests must be prepaid.

v.     All prices are quoted in Australian Dollars and include GST. 

vi.    Valid credit card details are required for security.  

vii.   Payment by Direct Bank Transfer is preferred. A 1.9% credit card fee applies to credit card transactions. 

4. CANCELLATIONS 

i.      Cancellations made outside six calendar months from the event - 100% refund. 

ii.     Cancellations made before 30 days of the event - 100% refund of the deposit, less a $500 administration fee.

iii.    All inspections and due diligence must be completed before making the booking. 

iv.    Cancellations made within seven days of the event are non-refundable - no exceptions.

v.     The Owner and Venue shall not be held liable for any interference, disruption, or enforced cancellation of any part of a booking caused by civil disturbance, industrial action, terrorism, an act of God, or any circumstance beyond the Venue's control. 

vi.    The Venue reserves the right to cancel bookings and refund payments should the need arise.

vii.   All cancellations are to be made in writing to lauderdalecottage@gmail.com 

 

5. QUOTATIONS 

i.      All quotes provided expire within seven (7) calendar days. 

ii.     Venue hire is on a 'first-come, first-served basis, and a quotation does not guarantee availability. 

iii.    The Venue reserves the right to vary prices after the quote’s expiration.

 

6. OBSERVANCE OF LAWS

i.      The Hirer shall comply with all rules and policies of the Venue, and with the provisions of all other Acts and Regulations applicable to the Hirer, and shall indemnify and keep indemnified the Owner and Venue against all losses, expenses, liabilities, claims and damages incurred as a result of the Hirer's breach of any such Act, Statutes, Rules or Regulations.

ii.     The Hirer agrees to indemnify the Owner and Venue against loss or damage it suffers if the Hirer, or a person admitted by the Hirer, to the Premises during the Hire Period:

a.   damages or destroys any property;

b.   injures any person;

c.   fails to observe any of the Hirer's obligations under this Agreement.

iii.    The Hirer shall not admit patrons to the Premises over the specified Estimated Attendance.

iv.    The Hirer shall not transfer or sub-let a right of the Hirer under this Agreement to another entity.

v.     The Venue reserves the right to remove any agents, employees, invitees or contractors of the Hirer from the premises if those persons break any obligations of the Hirer or engage in any conduct objectionable to the Venue.

 

7. CLEANING & GOOD ORDER

i.      Removing waste, equipment, and other items is the hirers' responsibility - grounds are to be left clean and tidy with all rubbish placed in the bins provided and the excess waste removed from the site. 

ii.     The Hirer shall be responsible for maintaining good order in and around the Premises during the hire period.

iii.    The Hirer shall comply with any instruction by the Owner/Venue and/or any of its officers. 

iv.    The Hirer shall take all reasonable steps to ensure all persons admitted to the Premises during the hire period observe these obligations at all times.

v.     The Hirer assumes full responsibility for guests' behaviour. Intoxicated people will be evicted from the premises at the discretion of the Venue.

vi.    The Hirer is to ensure that smoking occurs only in designated smoking areas where ashtrays are provided. 

vii.   The Hirer shall be responsible for leaving the Premises clean and tidy. At the expense of the Hirer, the Venue may carry out such cleaning or other work as may be required to restore the premises to a satisfactory condition.

 

8. LIABILITY AND INDEMNITY 

i.      The Hirer is responsible for the property from the commencement of the hire period until its end. The Hirer is liable for all damages to the property, including trees, props/furniture, buildings, lights, pathways, gates and other structures. The Hirer shall maintain at its expense liability, property and casualty insurance coverage in the amount necessary to fully protect the Venue against all claims, loss or damage of whatever nature or type. 

ii.     All damages, breakages, theft, or unaccounted equipment from the Venue will be charged to the Hirer's account. 

iii.    A cleaning security bond is required from the Hirer. The cleaning security bond, less any costs, will be returned to the Hirer seven days after the hire period. If the amount owing for damaged, dirty or non-returned items exceeds the bond paid, the Hirer must pay the difference. 

iv.    If the Owner/Venue is issued with a fine due to the actions of the Hirer, the fine will be payable by the Hirer. 

v.     The Hirer agrees to pay all charges for hire loss, hire extension, damage and repair, and all collection fees, legal fees, or any expenses involved in collecting these charges. 

vi.    The Hirer must take out or hold a public liability insurance policy in the name of the hirer current as at the Period of Hire. The Owner requires a copy of the Certificate of Currency showing Public Liability Insurance held. The Insurance Certificate, along with the completed Hire Agreement and Booking Application form, are to be submitted to enable booking confirmation.

 

7. DELIVERY, SET UP AND PICKUP 

i.      All deliveries and removals are to be via the Wilmslow Ave entrance. No trucks or vans are permitted through the Risdon Rd entrance. 

ii.     Deliveries must be either the day before and the day of the event. All pack-down and removal must occur on the following or next business day. 

iii.    Any deliveries made outside the Hire Period will incur an extra charge. Items, equipment, rubbish or vehicles not removed by 5 pm that day will result in forfeit of security bond.  

 

PUBLICITY

i.      Unless otherwise agreed, the Hirer shall not make any statement that directly or indirectly implies the use for which the premises are hired, conducted or promoted is by the Venue.

 

8. SECURITY

i.      The Hirer acknowledges:

a)   Unless otherwise agreed, access to the hired Premises will only be permitted during the hire period.

b)   Authorised Venue staff may be in attendance in and around the Premises during the Hire Period.

c)   Venue staff have authority to eject a person or persons from, or refuse entry to, the Premises or terminate an activity if in their judgment, the person or persons is/are not adhering to the conditions of this Agreement or the Premises are being used for a purpose other than that specified in this Agreement.

d)   the Venue may provide additional security measures for the Premises at the Hirers expense.

 

9. PLANNING 

i.      The Venue requires the Hirer to use a local wedding/event coordinator approved by the Venue to ensure your wedding runs smoothly. The Hirer must provide the coordinator's name and contact details at least three months before your event.
